The terms that apply when a consumer buys books, journals, workbooks or digital publications directly from The Thriving Mindset website.

These terms explain how direct purchases from The Thriving Mindset work. Please read them before placing an order. They are designed to sit alongside our Returns & Refunds Policy, Shipping & Delivery Policy, Privacy Notice and Wellbeing Disclaimer.
1. Who we are
The Thriving Mindset is a trading name of SCW Resources Limited, registered in England and Wales under company number 14817952. Our registered office is 22 Victoria Gardens, Cradley Heath, England, B64 5LX.

2. When these terms apply
These terms apply when a consumer buys a physical or digital publication directly through thethrivingmindset.co.uk. They cover books, journals, workbooks, bundles and other publications sold by us.
They do not apply when your payment is taken by Amazon, another bookseller, an app store or a different retailer. In that case, the retailer is the seller and its terms apply. Coaching is governed by a separate Coaching Client Agreement & Terms of Service. Separate written terms may apply to workshops, corporate services, subscriptions, trade sales or bulk business orders.
3. Product information
We take reasonable care to describe each product accurately, including its title, format, dimensions, page count, main features and any important use information. Images are illustrative. Colours and finishes may vary slightly between screens, print runs and production methods.
Books and journals may discuss wellbeing, leadership, burnout, personal change, money habits or other difficult experiences. They are educational and reflective resources, not clinical, medical, therapeutic, legal or regulated financial advice. Our Wellbeing & Self-Reflection Disclaimer forms part of the information supplied with these products.
4. Prices and delivery charges
Prices are shown in pounds sterling. The Thriving Mindset is not currently registered for VAT, so VAT is not added. Any unavoidable charge is included in, or clearly presented with, the total price before you commit to purchase. Delivery options and charges are shown before the order is placed.
We may change prices at any time, but a change will not affect an order that we have already accepted. Discount codes and promotions are subject to their stated conditions and availability.
5. Placing an order
1. Choose the product and format, review the description and add it to your basket.
2. Check the items, delivery address, delivery option and total price. The checkout should allow you to correct errors before payment.
3. Use the payment button to place an order with an obligation to pay.
4. We will send an acknowledgement that the order has been received. This acknowledgement does not necessarily mean that we have accepted the order.
5. A contract is formed when we send a dispatch confirmation for physical goods or make accepted digital content available, unless the order confirmation expressly states that the order has already been accepted.
The contract will be in English. Please save the order confirmation and these terms for your records.
6. Payment
Payment is taken using the methods shown at checkout. Payment providers may process card or account information under their own privacy and security terms. We do not normally receive or store full payment-card details.
If payment is not authorised, is reversed or cannot be completed, we may suspend or cancel the order and will contact you where reasonably possible.
7. Acceptance, availability and errors
All orders are subject to availability and acceptance. If a product is unavailable, cannot be supplied, or contains an obvious pricing or description error, we will contact you as soon as reasonably possible. We may offer a correction or replacement option, or cancel and refund the affected order. We will not substitute a materially different product without your agreement.
We may refuse an order where there is reasonable evidence of fraud, misuse of a promotion, unlawful activity or an attempt to purchase on terms not offered to consumers. Any refusal will be handled fairly and any payment taken for goods not supplied will be refunded.
8. Physical delivery
Our Shipping & Delivery Policy explains the destinations, dispatch times, delivery methods and steps to take if a parcel is delayed, lost or damaged. Unless another delivery date is agreed, we will deliver within 30 days after the contract is made.
Risk of loss or damage passes to you when the goods are delivered to you, or to a person you identify to receive them. Ownership passes when we have received full payment and the goods have been delivered.
9. Your delivery information
You are responsible for checking that the name and delivery address are complete and accurate before placing the order. Contact us immediately if you spot an error. We will try to help, but we cannot promise to amend an order after it has entered fulfilment.
If a parcel is returned because the address supplied was incomplete or incorrect, we may ask you to pay the actual, clearly explained cost of redelivery. This does not affect your rights where the problem was caused by us or the carrier acting on our behalf.
10. Cancelling a physical-product order
For most physical products bought online, you may tell us that you want to cancel within 14 days after delivery and then return the item within a further 14 days. Our Returns & Refunds Policy explains the process, return costs, refunds and exceptions, including genuinely personalised products.
Nothing in these terms reduces a statutory right to cancel, reject faulty goods or obtain another legal remedy.
11. Faulty, damaged or misdescribed goods
Physical goods must be as described, of satisfactory quality and fit for their normal purpose. If an item arrives damaged, contains a printing or binding fault, is incomplete or is not what you ordered, contact us promptly. Your remedies may include replacement, repair where appropriate, price reduction or refund. Our Returns & Refunds Policy gives the practical route.
12. Signed and personalised products
A standard signed copy is generally treated like another physical book. A product created to your specification, such as a named dedication or personalised message, cannot normally be cancelled merely because you change your mind. This exception does not remove rights where the item is faulty, damaged, misdescribed or the personalisation is not what was agreed.
13. Digital publications
If we sell an e-book, printable resource or other digital content directly, the product page will explain the format, compatibility, access method and any technical requirements that are reasonably relevant.
You normally have a 14-day cancellation period for digital content. That right can end when supply begins only if you have expressly asked for immediate supply and acknowledged that the cancellation right will be lost. The checkout must record both points before an immediate download or access is supplied.
Digital content must be of satisfactory quality, fit for purpose and as described. If it is faulty, contact us. Consumer law may give you a right to repair or replacement, or a price reduction or refund where the problem cannot be resolved within a reasonable time and without significant inconvenience.
14. Digital-use licence
Unless a product page says otherwise, a direct digital publication is licensed to the purchaser for personal, non-commercial use. You may download and use it for your own reflection or learning. You must not reproduce, upload, sell, distribute, share access widely, remove ownership notices or use it to create a competing product without written permission. Statutory rights and legally permitted uses are not restricted.
15. Pre-orders
A pre-order reserves a product that is expected to be released or dispatched later. The estimated date will be shown on the product page or order confirmation. Dates can change for production or fulfilment reasons. If a material delay occurs, we will provide updated information and explain available cancellation or refund options.
16. Bundles, offers and discount codes
A promotion may have a closing date, product limit, customer limit or other clearly stated conditions. Discount codes have no cash value and cannot be applied retrospectively unless we choose to do so. We will not use promotions, countdowns or stock messages in a misleading way.
If a partial return means that a multi-buy condition is no longer met, the refund may reflect the price that properly applies to the items kept. Any adjustment will be explained and will not reduce statutory rights.
17. Reviews and testimonials
Where the website publishes customer reviews or testimonials, they must reflect genuine experiences. Incentives, gifted products or other relevant relationships must be disclosed clearly. We may moderate unlawful, abusive, irrelevant or demonstrably fake material, but we will not suppress genuine criticism merely because it is negative.
18. Intellectual property
Copyright, trade marks, designs and other intellectual property in our publications, branding and original content belong to us or the identified creator or licensor. Buying a product gives you ownership of the physical copy, or a personal-use digital licence, but does not transfer the intellectual property in the work.
19. Our responsibility to you
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable when the contract was made.
Our products are supplied for personal use. We are not responsible under a consumer contract for business losses, including loss of profit, revenue, business opportunity or business interruption.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights, or any liability that cannot lawfully be excluded or limited.
20. Events outside reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control, provided we take reasonable steps to reduce the effect, keep you informed and perform the contract as soon as reasonably possible. If a substantial delay affects an essential delivery date, your legal cancellation rights may apply.
21. Complaints
Please contact us first at thethrivingmindset@yahoo.com and include your order number and a clear description of the issue. We will investigate fairly and explain our response in plain English. You may obtain independent consumer advice through Citizens Advice or the equivalent service in Scotland or Northern Ireland. Using our complaints process does not remove your right to pursue another legal remedy.
22. Changes to these terms
We may update these terms when our products, website, fulfilment model or legal duties change. The version made available before you place an order will normally apply to that contract, unless a later change gives you greater rights or the law requires otherwise.
23. General legal terms
If one part of these terms is found to be unlawful or unenforceable, the remaining parts will continue to apply. A delay in enforcing a right does not waive that right. We may transfer our rights and obligations only where this does not reduce your rights. You may transfer your rights where the law allows or with our written agreement. No person other than you and us has a right to enforce this contract.
24. Governing law and courts
These terms are governed by the law of England and Wales, while preserving any mandatory consumer protections that apply where you live. If you live in England or Wales, you may bring proceedings in those courts. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the UK where you live.
